Rapidshare ordered to proactively filter pirated content A higher court in Germany has ruled this week that cyberlocker Rapidshare must proactively filter pirated content from its site.
The decision upholds similar rulings from lower courts, each of which said the cyberlocker did not do enough to prevent piracy on its servers.

Germany's ruling covers both music and book downloads and dated back to an original case in 2009 brought by GEMA, a German organization representing that country's composers, vocalists, and music publishers.

Although the ruling has not been made public yet, reports say Rapidshare will have to monitor all the files uploaded before they are made available to download via the site.

Because such an endeavor would be impossible for Rapidshare staff, the cyberlocker will clearly need to create a software or script to filter the content.

This sounds not only a physical impossibility to monitor, it also sounds like a violation of civil rights to several degrees (dependent on the countries each boarder it crosses).

We're not talking about scanning a suitcase for a satchel bomb here folks. This is nothing more than some idiot asshole whining about content that really doesn't originally belong to them. Either side of the fence. Making ANY of the cyber lockers responsible for the actions of the users is BS & they know it. They're not a security team & have no authority other than the ability to remove the files & ban the user.

IF they can even comb through the mass of data.

thats all they care about. they dont give a shit whats REALLY in it. as long as the name is legal.

They would not be using just titles, they will be using checksums most likely. How they will get into encrypted files is a different story..

Here is an analogy I have not heard anyone say:

To make file hosting sites responsible in any way for what is uploaded to their servers would be no different than doing the same to storage facilities that rent out space for tenants to store 'their' 'belongings'.

Are we going to require that storage facilities inspect, analyze, and inventory all prospective and current clients stuff. Yes, they will get some "illegal" stuff periodically. But this is not their responsibility in our society. Even if someone said to the storage facility owner that a tenant stole their stuff and was hiding it in one of their rented units, the facility owner is under no obligation to do anything about it, nor could he, aside from informing police what unit was rented, should he CHOOSE to do so.

These scenarios require a thing called "Due Process" which begins with reasonable suspicion, gathering of evidence,and presentation to a judge in order to secure a VALID warrant. What this DMCA nonsense proposes flies in the face of centuries of convention and precedent.

This whole concept is completely asinine and is going to get tossed by any judge with an ounce of sense.

@SoulGlow, I think a couple of us have mentioned something along the same lines as what you have said. Speaking for myself, you were just much more elegant in your depiction.

Where you have gold lame & porcelain, I use a dull knife & a sledge hammer. But you are right, it's amazing how everyone wants justice/fairness until they have been victimized. Or perceive they have been victimized.

I think we've all had a turn saying it repeatedly, the studios haven't lost a dime (within real reason) on any entertainment venture they've invested in. Any outcry of negativity otherwise is a ruse & those of us with even functioning autism know it.

They're nothing more than mean little bastard children methodically stomping their plastic Army soldiers out of the daylight from the confines of their sandbox. Now they want to race over into the neighboring sandboxes & stomp those toys under as well.
